PART A: Answer the following questions using only material provided (500 words) NO OUTSIDE SOURCES
Restorative Justice is included within the YCJA under sections 3, 19, 38 and 42 and communicates to justice professionals, victims and the community that victims have an important role to play in the justice system. How does giving victims a larger role in the youth justice system – such as information about the charges, victim impact statements at sentencing, or participation in conferences – change the traditional adversarial structure of the system? How does their larger role and participation shift the structure and objectives of other participants in the criminal justice system? Think about the accused, the police, the Crown prosecutor. Some argue that while victims have a substantially larger and important role in the YCJA than during the YOA, it is not enough. Others argue that we need to put some limits on the role of victims and their inclusion in the youth justice system and therefore the current inclusion of victims is enough. What is your position here?
